Moms thinking about divorce; what you want to know about child custody.
I often have women calling me that are thinking about divorce but are scared that they may lose custody of their children. Customarily, in my experience, I have found it to be very rare that a mother loses custody of her children.
That said, in any situation where child custody rights are at issue, several essential matters are raised, and the laws vary from state to state.
In Bergen County, New Jersey, Family Court, in my practice, I found that child custody and visitation will often either be worked out by settlement between the divorcing couple (ordinarily with the help of attorneys and mediators) or sometimes by the court. If unmarried parents do not reach child custody and visitation agreement out-of-court, the case can go before a family court judge for resolution. And in my experience for either situation, a mother rarely loses custody, unless, for example, she is unfit.
